Terms of Service

1. Acceptance

By accessing or using Lumen ("Lumen", "the Service") at ask.eliteaiempire.com or via its API, you agree to these Terms of Service and to our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the Service. You must be at least 13 years old (or the minimum digital- consent age in your jurisdiction) to use Lumen.

2. What Lumen is

Lumen is an AI-powered answer engine. It retrieves information from public web sources and uses large language models to synthesize a response. Lumen also offers an optional "agentic" mode, browser automation, a sandboxed code terminal, third-party connectors, image understanding and generation, and an optional user-installed Local Agent.

3. AI output — accuracy and "not advice" disclaimer

Lumen's answers are generated by AI and may be inaccurate, incomplete, out of date, or misleading. AI models can "hallucinate" — state false information confidently. Lumen includes grounding and verification safeguards, but they are not perfect and do not guarantee correctness.

Lumen does not provide professional advice. Nothing Lumen outputs is, or is a substitute for, professional legal, financial, investment, tax, medical, mental-health, or other licensed advice. Do not rely on Lumen for any decision that requires a qualified professional. Always independently verify important information and consult an appropriate licensed professional. In an emergency, contact local emergency services.

4. Source content and intellectual property

Lumen synthesizes answers from third-party web sources and cites them with numbered references and links. Lumen does not claim ownership of that underlying source content; rights remain with the original publishers. Citations are provided so you can verify and attribute information at its source. You are responsible for independently confirming the licensing of any source material before reusing it. If you believe Lumen has surfaced content that infringes your rights, contact us at the address in Section 14 and we will act on valid notices.

As between you and us, you retain all rights to the prompts, files, and other content you submit ("Input"), and, to the extent permitted by law, you own the AI responses generated for you ("Output"). You grant us a limited licence to process Input and Output solely to operate, secure, and improve the Service. Output may be similar or identical to output provided to other users; Lumen does not guarantee Output is unique or non-infringing.

5. Acceptable use

You must comply with the Acceptable Use Policy. In short: do not use Lumen to facilitate violence, weapons, explosives, bioweapons, child sexual abuse material, or other operational harm; do not attempt to defeat its safety systems; do not use it for unlawful surveillance, harassment, fraud, malware, or spam. We may screen, filter, refuse, or terminate requests that violate this policy.

6. The Local Agent — code execution on your machine

The Lumen Local Agent (lumen-local-agent.py) is an optional program that you download and run on your own computer. See Section 8 of the Privacy Policy and the consent notice shown on the download page for the full scope, limits, and disclaimer. By running it you accept sole responsibility for what it does on your machine.

7. Plans, billing, and metered API usage

Lumen offers a free tier and paid subscription tiers (Pro, Max, Power, Enterprise). Subscriptions are billed in advance through our payment processor (Stripe) on a recurring basis until cancelled. The Lumen API is additionally available on a pay-as-you-go metered basis: API usage is metered and billed separately from any subscription at approximately $0.005 per request (the current rate is shown on the Pricing page and may change with notice). Metered charges accrue with usage, have no fixed quantity, and are reported to Stripe and invoiced on your billing cycle. You authorise us and Stripe to charge your payment method for all subscription and metered amounts you incur. Fees are non-refundable except where required by law. Taxes are your responsibility. You can cancel at any time from your Account; cancellation stops future renewals but does not refund the current period or already-accrued metered usage.

8. Third-party services and connectors

Lumen integrates third-party model providers, search, payment processing, and connector platforms (see Subprocessors). When you connect an external account (e.g. via OAuth) or invoke a connector, your use of that third party is also governed by that third party's terms and privacy policy. We are not responsible for third-party services.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any Output is accurate or reliable.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE AI EMPIRE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF — OR INABILITY TO USE — THE SERVICE OR ANY OUTPUT. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 3 MONTHS BEFORE THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow these limits, so they may not fully apply to you.

11. Indemnification

You agree to indemnify and hold harmless Elite AI Empire and its operators from claims, losses, and expenses arising from your Input, your use of Output, your use of the Local Agent, or your violation of these Terms or applicable law.

12. Termination

You may stop using Lumen at any time. We may suspend or terminate access — with or without notice — for violation of these Terms or the Acceptable Use Policy, or to comply with law or protect the Service or its users.

13. Changes

We may update these Terms. Material changes will be reflected by an updated "Last updated" date and, where appropriate, additional notice. Continued use after changes take effect constitutes acceptance.

14. Governing law and contact

These Terms are governed by applicable law without regard to conflict-of-law rules. The specific governing jurisdiction and any dispute-resolution / arbitration clause are pending legal review — see the operator notice. Contact us at legal@eliteaiempire.com.
